South Africa's Malema To Serve Five Years in Prison

South Africa's Economic Freedom Fighters leader Julius Malema has been sentenced to five years of direct imprisonment following his firearm handling and discharge case, with the ruling delivered at the East London Regional Court on Thursday, April 16th 2026.
According to reports, Magistrate Twanet Olivier handed down the sentence after closing arguments were heard the previous day. The conviction stems from a video circulated online, recorded during the EFF's fifth anniversary celebrations at the Sisa Dukashe Stadium in Mdantsane on 28 July 2018, in which Malema is seen firing what appeared to be a rifle in front of thousands of supporters. Malema had pleaded not guilty, telling the court the firearm was a toy.
In her ruling, Magistrate Olivier dismissed the defence's characterisation of the shooting as a celebratory act. She described it as "nonsensical" to frame the discharge of a firearm as a celebratory shot, stating that Malema knew what he was doing was unlawful and that the events were pre-planned.
"It wasn't an impulsive act. It wasn't anger. It was the event of the evening," she said.
Malema, 45, was convicted last year on five charges, including unlawful possession of a firearm and discharging a weapon in a public place. He was also declared unfit to possess a firearm.
Malema's lawyers applied for leave to appeal the magistrate's decision within minutes of it being read out in court. His legal representatives, including Advocates Tembeka Ngcukaitobi and Laurance Hodes, had argued during sentencing proceedings that no injuries or damage resulted from the incident, and that prosecutions of this nature are rare in South Africa.
"To send any person to prison for this single event would be shockingly inappropriate," Hodes had told the court.
The sentence, if confirmed after all appeals, would bar Malema from serving as a lawmaker — a major setback for the EFF, which draws strong support among young South Africans frustrated by the racial inequality that has persisted since the end of white minority rule in 1994.
Scores of EFF supporters gathered in KuGompo City ahead of the sentencing, with the party booking Jan Smuts Stadium for the majority of its supporters to follow proceedings on large screens.
The appeal process is expected to be protracted, and Malema's immediate incarceration remains subject to the outcome of those proceedings.
